Terms and Conditions

These Terms and Conditions ("Terms") form a legally binding agreement between you ("you," "user," or "Member") and MyBrothersKeeper ("MBK," "we," "us," or "our") governing your access to and use of mybrotherskeeper.cc, our mobile applications, and related products and services (collectively, the "Service").

By creating an account, downloading the app, connecting a wearable or Snapchat account, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years of age (or the minimum digital-consent age in your jurisdiction) to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13.

MyBrothersKeeper is a free, advertising-supported fitness accountability platform that may include wearable activity syncing, community and Snapchat-linked features, Walk-to-Earn points, leagues, leaderboards, and related social or reward experiences. Features may change, be limited by region, or be discontinued at our discretion.

MBK is not a medical device and does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before beginning any exercise program. You use fitness data and recommendations at your own risk.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms, appear fraudulent, or pose a security or legal risk.

If you connect devices or accounts from third parties (including Apple, Garmin, Fitbit, Oura, Samsung, Whoop, Polar, and similar manufacturers, or Snapchat), you authorize us to receive and process data those services make available, subject to their terms and your privacy settings. We do not control third-party products and are not liable for their availability, accuracy, or policies.

Hardware brand names are used for compatibility description only and do not imply endorsement, partnership, or affiliation unless expressly stated.

Optional Snapchat features may allow you to share activity, discover other Members at a similar fitness level, earn merit, and join leagues. Level matching and league placement are algorithmic estimates based on activity and engagement data and may change. Merit and league status have no cash value unless we expressly state otherwise in a separate reward program, and may be adjusted or reset for abuse, cheating, or technical error.

You must comply with Snapchat's terms and community guidelines. MBK is not affiliated with Snap Inc. except as a user of publicly available platform integrations or partner programs, where applicable.

Points, badges, streaks, and rewards are promotional and may be modified, capped, or discontinued. Unless required by law, points are not property, wages, or transferable currency. We may withhold rewards obtained through fraud, bots, GPS spoofing, or manipulation of wearable data.

The Service is free and supported by advertising. You may see ads, sponsored placements, or branded challenges. Ad personalization, where used, is described in our Privacy Policy. You agree not to interfere with ad delivery mechanisms except through available preference controls.

You agree not to:

• Harass, threaten, or impersonate others;
• Post unlawful, defamatory, or sexually exploitative content;
• Scrape, reverse engineer, or overload the Service;
• Falsify activity, location, or wearable data;
• Use the Service for commercial resale without our written consent.

The Service, branding, software, and content we provide are owned by MBK or its licensors. You receive a limited, revocable, non-exclusive license to use the Service for personal, non-commercial purposes. You retain rights in content you upload, and grant us a worldwide, royalty-free license to host, display, and distribute that content as needed to operate and promote the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THE ACCURACY OF HEALTH OR ACTIVITY METRICS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MBK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNTS YOU PAID US (IF ANY) IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless MBK and its officers, directors, employees, and agents from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules. Except where prohibited, disputes shall be resolved individually in the state or federal courts located in Delaware, and you waive class actions to the fullest extent permitted. Consumers in the EU/UK may have mandatory local rights that prevail.

We may update these Terms by posting a revised version with a new "Last updated" date. Material changes may be communicated in-app or by email where appropriate. Continued use after the effective date constitutes acceptance. We may suspend or end the Service or your access at any time.
